SINCE THE APPOINTMENTS OF THE INTEGRITY COMMISSIONER ALMOST TWO YEARS AGO, WE HAVE HAD THE OPTION OF HAVING THE INTEGRITY COMMISSIONER AVAILABLE TO PROVIDE GUIDANCE TO THE MEMBERS OF CITY COUNCIL, AS WELL AS TO BE ABLE TO FIELD ANY CONCERNS OR QUESTIONS THAT MEMBERS OF THE PUBLIC MAY HAVE ABOUT THE ACTIONS OF MEMBERS OF COUNCIL.

WITH PLEASURE, WE HAVE THE INTEGRITY COMMISSIONER HERE WITH US TODAY, SHELDON TONER, AS PART OF DRAGON TONER, THE COMPANY THAT HAS TO CONTRACT FOR THIS.

IT IS VERY IMPORTANT THAT ANNUALLY AN OPEN AND TRANSPARENT UPDATE ON THE WORK OF THE INTEGRITY COMMISSIONER RELATIVE TO THE SUPPORT FOR CITY COUNCIL IS MADE AVAILABLE TO THE PUBLIC.

SO WE'RE VERY PLEASED TO HAVE MR. TONER HERE TODAY IN HIS ROLE AS INTEGRITY COMMISSIONER TO BE ABLE TO PROVIDE AN UPDATE ON WHAT'S GOING ON OVER THE PAST YEAR.

I'M PLEASED TO PRESENT MY SECOND ANNUAL REPORT OF THE INTEGRITY COMMISSIONER.

THE REPORTING PERIOD COVERED BY THIS REPORT IS FROM SEPTEMBER 2019 TO SEPTEMBER 2020.

THE REPORT WILL BE BRIEF SINCE THERE WERE VERY FEW MATTERS BROUGHT FORWARD TO MY ATTENTION.

THIS BEING THE SECOND YEAR OF THE INTEGRITY COMMISSIONER POSITION BEING IN EXISTENCE.

IT'S STILL BEEN PRETTY QUIET AND THERE HASN'T BEEN A LOT OF ACTIVITY.

YOU MAY RECALL THAT LAST YEAR WHEN I DELIVERED THE FIRST ANNUAL REPORT, WE HAD A REFRESHER ON STANDARDS OF CONDUCT, RESPECTFUL WORKPLACE AND ANTI HARASSMENT POLICY, CONFLICTS OF INTERESTS AND RULES AROUND GIFTS AND HOSPITALITY, AS WELL AS STEPS INVOLVED IN THE COMPLAINT AND INVESTIGATION PROCESS.

I'M PLEASED TO SAY THERE WERE NOT ANY COMPLAINTS WITHIN THE REPORTING PERIOD OF THIS SECOND ANNUAL REPORT.

I WAS CONTACTED ON TWO OCCASIONS TO ADDRESS QUESTIONS REGARDING POTENTIAL CONFLICTS OF INTERESTS AND CONSIDERATIONS AROUND DISCLOSURE, POSSIBLE RECUSAL FROM DELIBERATIONS.

THOSE WERE CONTACTS BY MEMBERS OF COUNCIL.

ON A THIRD OCCASION TO DISCUSS A POTENTIAL ISSUE UNDER THE COUNCIL CODE OF ETHICS, BYLAWS, STANDARDS OF CONDUCT.

IN ALL THOSE CASES I WAS ABLE TO RESPOND TO THE QUESTIONS INFORMALLY AND CONFIDENTIALLY AND RESPECT THAT CONFIDENTIALITY HERE AND NOT GO INTO THE DETAILS OF THOSE CONTACTS.

ONE THING I WOULD LIKE TO NOTE IS THAT WITH RESPECT TO CONFLICTS OF INTERESTS, WHEN I GET A CALL, MY RESEARCH INEVITABLY TAKES ME TO JURISDICTIONS WHERE THERE'S MORE OF A BODY OF INTEGRITY COMMISSIONER REPORTS IN RESPONSE TO COMPLAINTS.

THAT WOULD BE ONTARIO IN PARTICULAR.

THERE'S A LARGE VOLUME OF INTEGRITY COMMISSIONER REPORTS STARTING TO DEVELOP IN THAT JURISDICTION.

WHAT I HAVE FOUND IS THAT WITH THE LEGISLATION IN ONTARIO, THE MUNICIPAL CONFLICT OF INTEREST ACT, IT DOES CONTAIN A PROVISION WHERE COUNCIL MEMBERS CAN BE EXEMPTED FROM OTHERWISE STRICT REQUIREMENTS FOR DISCLOSURE AND RECUSING BY REASON ONLY OF AN INTEREST OF THE MEMBER WHICH IS SO REMOTE OR INSIGNIFICANT IN ITS NATURE THAT IT CANNOT REASONABLY BE REGARDED AS LIKELY TO INFLUENCE THE MEMBER.

THAT'S AN EXEMPTION THAT ALLOWS COUNCIL MEMBERS TO NAVIGATE THE DAY-TO-DAY POTENTIAL CONFLICTS THAT ARE QUITE COMMON IN MUNICIPAL POLITICS.

I WOULD THINK IN SMALLER AND SMALLER MUNICIPALITIES IN PARTICULAR.

THE NORTHWEST TERRITORIES DOESN'T HAVE THAT EXEMPTION IN IT'S CONFLICT OF INTEREST ACT.

BUT IT IS SOMETHING THAT I SEE IN MANY OF THE INTEGRITY COMMISSIONER DECISIONS.

IT'S OFTEN SOMETHING THAT ALLOWS MINOR POTENTIAL CONFLICTS TO BE RESOLVED OR ADDRESSED.

IT'S MAYBE SOMETHING TO FLAG AS A POTENTIAL EXEMPTION TO LOOK AT IN

A POSSIBLE AMENDMENT DOWN THE ROAD TO OUR COMPLEX OF INTEREST ACT OR YOUR BYLAWS OR YOUR CODE OF ETHICS.

THAT'S SOMETHING THAT I'D BE PREPARED TO DISCUSS DOWN THE ROAD.

PLANS FOR THE FUTURE.

I HAVE THE IDEA THAT IT MIGHT BE BENEFICIAL TO HAVE A GUEST SPEAKER FROM ONE OF THE LARGER JURISDICTIONS COME AND SPEAK TO SOME OF THE CASES THAT THEY'VE ADDRESSED IN MUNICIPAL ETHICS.

AN INTEGRITY COMMISSIONER FROM ONTARIO WORLD BURGER OR SOMEWHERE LIKE THAT WHERE THEY HAVE STARTED TO DEVELOP MORE OF A BODY OF REPORTS AROUND THIS.

I STILL HAVE ON THE AGENDA CONFERRING WITH THE CITY OF YELLOWKNIFE TO ENSURE THE PUBLIC HAS INFORMATION AND ACCESS TO THE FORMAL COMPLAINT PROCESS THAT WAS ON MY AGENDA FOR LAST YEAR.

IT DIDN'T HAPPEN, I LARGELY BLAMING COVID FOR NOT PUTTING THAT TOGETHER.

BUT I THINK IT WOULD BE SOMETHING BENEFICIAL GOING FORWARD.

I HOPE TO DO THAT IN THE COMING YEAR.

TECHNICALLY, IF WE BUY A MEMBERSHIP AT THE SKI CLUB WHERE A MEMBER WE'RE SUPPOSED TO EXCUSE HERSELF FOR DELIBERATIONS IF THEY'RE SUBJECT TO IT.

WOULD IT BE EXAMPLES LIKE THAT, THAT YOU WOULDN'T HAVE TO DECLARE A CONFLICT IF IT'S MINOR AND THAT GRANTING OF COMMUNITY EVENTS?

IN A SMALL COMMUNITY, IT DOESN'T TAKE LONG BEFORE YOU HAVE A CONFLICT OF THAT NATURE.

THEN THE REQUIREMENTS ARE TO DISCLOSE THAT AND RECUSE.

THE EXEMPTION ALLOWS FOR CONSIDERABLE MORE FLEXIBILITY.

MY NAME IS GONZALO ESPINOSA.

I'M PRESIDENT OF THE YELLOWKNIFE MOUNTAIN BIKE CLUB, AND WITH SHANNON, SHE'S THE VICE PRESIDENT, AND LILITH BROOK, SHE'S OUR SECRETARY.

TODAY, THE PURPOSE OF THE PRESENTATION IS TO PROVIDE AN UPDATE AND REFRESH OUR MEMORIES WITH OPERATION BIKE PARK.

WE'RE JUST GOING TO START DOING THIS.

FIRST, OUR MISSION IS TO PROMOTE A HEALTHY LIFESTYLE FOR MOUNTAIN BIKING AND PROVIDE A SAFE AND FRIENDLY ENVIRONMENT FOR A MOUNTAIN BIKE RIDES, EVENTS, AND SERVICE PROJECTS.

WHAT IS A BIKE PARK? IT'S AN AREA THAT IS GOING TO BE DEDICATED TO MOUNTAIN BIKING OR BIKING IN GENERAL.

IT HAS FEATURES THAT FACILITATE THE INCREASE OF BIKE HANDLING SKILLS FOR EVERYONE.

WE STARTED WITH A VISION FOR THE MOUNTAIN BIKE PARK AND THIS IS OUR MAIN GOAL EVENTUALLY.

THIS IS OUR LARGER VISION AND IT'S GOING TO BE LOCATED IN BRISTOL PIT.

THESE ARE THE MAIN COMPONENTS OF OUR ULTIMATE GOAL.

WE'RE BUILDING THE PARK BASED ON COMMUNITY FEEDBACK.

THIS IS GOING TO BE A CENTER TO BE USED BY THE ENTIRE COMMUNITY.

THIS FACILITY HAS PLENTY OF ROOM TO GROW.

WE STARTED THIS PROJECT WITH THE CURRENT STATE OF MOUNTAIN BIKING IN YELLOWKNIFE.

THERE'S A LOT OF INTEREST FROM YOUTH IN MOUNTAIN BIKE.

WE SEE KIDS RIDING THEIR BIKES ALL THE TIME.

FOR EXAMPLE, MBM CAMP, THEY HAD HAD 150 KIDS LAST YEAR.

THERE'S A GREAT INTEREST IN THE COMMUNITY FOR THIS PROJECT.

A LITTLE BIT OF HISTORY IN THE PROJECT WE STARTED IN 2017 WITH OUR COMMITTEE SURVEY.

THAT'S WHAT KICK-STARTED EVERYTHING.

WE PARTNERED IN 2018 WITH THE ROTARY CLUB.

THEY HAVE PROVIDED FINANCIAL SUPPORT, BUT THEY ALSO HAVE PROVIDED EXPERTISE.

THEY HAVE BEEN REALLY GOOD TO US IN TERMS OF ADVICE AND WHAT TO DO.

WE GOT MORE FEEDBACK IN 2019 IN TERMS OF THE DESIGN.

IN 2020, WE DECIDED TO FOCUS MORE ON A PUMP TRACK.

THAT WOULD BE A FIRST INSTALLMENT FOR OUR PARK.

IT WOULD BE AN EASY, ACHIEVABLE GOAL THAT WE CAN START GETTING MORE MOMENTUM.

NOW BRINGS US TO 2021.

WE HAVE A SUMMER TARGET DATE FOR THE CONSTRUCTION OF THIS PUMP TRACK.

WHAT IS A PUMP TRACK? A PUMP TRACK BASICALLY IS MADE OF ASPHALT AND IT'S A LOOP THAT HAS DIFFERENT FEATURES LIKE UP AND DOWN AND TURNS, AND FACILITATES MOUNTAIN BIKING, AND IT'S ACTUALLY PRETTY FUN.

OUR BUDGET IS $150,000 FOR THIS.

IN RECENT MONTHS, WE HAVE HAD A LOT OF PROGRESS IN OUR PROJECT, MAINLY FUNDRAISING WITH THE ROTARY CLUB, ELKS LODGE, AND SOME OTHER VENUES.

WE ALSO HAVE LOCAL PARTNERS IN CONSTRUCTION ACCOMMODATION THAT ARE READY TO SUPPORT US WHEN THE TIME COMES, THE SUMMER.

ANOTHER FUNDRAISING THERE WE'RE STILL ABOUT TO DO IS HAVE A 50-50 DRAW ON SOME OF THE SPONSORS THAT HAVE COMMITTED SUPPORT SUCH AS VOLUNTEERS AND LABOR WHEN THE TIME COMES.

ON THE ADMINISTRATIVE SIDE, YKDFN, THEY HAVE CONFIRMED THEIR SUPPORT FOR THIS PROJECT.

WE HAVE SECURED INSURANCE AND WE'RE PRETTY MUCH READY

TO SIGN THE CONTRACT TO START THIS CONSTRUCTION.

WHAT WE NEED TO DO NOW, WE'RE STILL WAITING, IS WE HAVE OUR DRAFT LIST READY, BUT WE NEED TO HAVE A FINALIZED LIST TO SECURE CONSTRUCTION.

OUR CONSTRUCTION TARGET DATE IS AT THE END OF THE SUMMER.

THIS BRINGS US TO THE FUTURE, WHAT WE WANT TO DO AFTER THE PUMP TRACK.

FIRST OF ALL, THE PUMP TRACK IS GOING TO BE FREE ACCESS TO ANY RESIDENT OR VISITOR TO YELLOWKNIFE.

IT WILL ADD ANOTHER OUTDOOR RECREATION FACILITIES, SAME AS IF WE BUILD, FOR EXAMPLE, A BASEBALL FIELD.

THE MAINTENANCE, WE'RE COMMITTED TO THE UPKEEP OF THE PUMP TRACK, BUT WE'RE ALSO LOOKING FOR A PARTNERSHIP WITH THE CITY OF YELLOWKNIFE FOR THE FUTURE, AND ALSO THE POTENTIAL WAVING OF LEASE AND TAXES FOR THIS LAND.

THAT IS GOING TO BE THE START TO THE MOUNTAIN BIKE SKILLS PARK.

THAT'S STILL OUR VISION AND WILL CONTINUE TO WORK TOWARD COMPLETION OF THAT PROJECT.

WHILE I SAY PUBLICLY, I DO ALSO WANT TO SAY THAT THE MOUNTAIN BIKE CLUB HAS BEEN TERRIFIC ABOUT WORKING WITH CITY ADMINISTRATION AND CITY STAFF ON SOME OF THE DETAILS AROUND PROCEEDING WITH THE PROJECT AT THIS TIME.

WE WELCOME THE COLLABORATION AND WHAT WE DO KNOW IS WE'LL CONTINUE TO WORK WITH THE MOUNTAIN BIKE CLUB TO BRING FORWARD THE PROPOSED ACCESS THAT THEY'RE SEEKING, WHICH WOULD BE A LEASE.

A LEASE THAT'S LONGER THAN THREE YEARS, OF COURSE, REQUIRES COUNCIL APPROVAL.

THIS WILL COME BACK TO GPC AND TO COUNCIL FOR ULTIMATE APPROVAL.

OF COURSE, WHAT'S REALLY IMPORTANT OUT OF THIS FROM CITY ADMINISTRATION'S POINT OF VIEW IS THAT IT'S IMPORTANT FOR US TO KNOW THAT THERE'S CLEAR EXPECTATIONS AROUND RESPECTIVE ROLES AND RESPONSIBILITIES.

THAT'S REALLY GREAT AND THE PRESENTATION WAS CLEAR ON THAT, AND WE'LL WANT TO CERTAINLY MAKE SURE THAT THAT IS VERY CLEARLY UNDERSTOOD BY BOTH SIDES WHEN IT COMES TO HOW WE SUPPORT WHAT YOU GUYS ARE DOING AND YOUR VISION.

I'M WONDERING IF THEY SIMILARLY HAVE A LEASE SITUATION WITH THE CITY FOR ALL THE WORK THAT THEY'RE DOING IN THE GRAVEL PIT AND RUNNING THAT CLUB, AND HOW THAT WORKS.

I GUESS THEY OVERARCHING QUESTION IS WHY THE MOUNTAIN BIKE CLUB NEEDS THIS LEASE AND LAND AND TO SECURE FAIRLY SIGNIFICANT INFRASTRUCTURE LIKE PUTTING IN AN ASPHALT TRACK THAT, OF COURSE, MIGHT REQUIRE REMEDIATION OR SOMETHING LIKE THAT IN THE FUTURE, WHEN THEY COULD JUST BUILD A DIRT TRACK WITHOUT A LEASE.

I'M WONDERING, MAYBE THE SNOWBOARDING CLUB DOES HAVE A LEASE AND I'M JUST NOT AWARE OF IT, BUT IT JUST SEEMS LIKE IF WE'VE GOT CLUBS DOING A SIMILAR THING WHERE THEY ARE ACTUALLY BUILDING A CERTAIN AMOUNT OF INFRASTRUCTURE AT THE GRAVEL PIT, WHY THEY'RE ALLOWED TO DO IT WHEN BIKE CLUB ISN'T.

ADMINISTRATION IS PLEASED TO PRESENT TWO GPC AND ULTIMATELY TO COUNCIL, THE CITY'S PROPOSED ASSET MANAGEMENT POLICY, WHICH WILL PROVIDE A HIGH-LEVEL FRAMEWORK FOR OUR APPROACH TO ASSET MANAGEMENT.

OF COURSE AS COUNCIL MEMBERS KNOW, ASSET MANAGEMENT IS THE PRACTICE THAT FOCUSES ON MAXIMIZING THE VALUE THAT IS DELIVERED BY THE ASSETS THAT WE OWN.

THIS HAS BEEN A LONG TIME COMING, AND IT IS BASED ON THE INITIAL DIRECTION THAT WAS SET THROUGH THE ASSET MANAGEMENT ROADMAP THAT COUNCIL APPROVED IN 2019.

HAVING A POLICY ON ASSET MANAGEMENT IS REALLY IMPORTANT BECAUSE WHAT THAT DOES IS IT CONFIRMS PUBLICLY, OUR COMMITMENT TO OPERATE AND MAKE DECISIONS BASED ON A STANDARD, WITH THE FOUNDATION BEING THE PRINCIPLES OF SERVICE DELIVERY, DATABASE DECISION-MAKING, MINIMAL SUSTAINABLE COST, RISK MANAGEMENT, AS TAKING A SYSTEMS LENS FOR WHOLE ORGANIZATION, AND OF COURSE COMMITMENT TO CONTINUOUS IMPROVEMENT.

WHILE THE OBVIOUS THINGS ARE THINGS LIKE THE WATER TREATMENT PLANT OR THE MULTIPLEX OR CITY HALL, THERE ARE OTHER ASSETS AS WELL.

THAT MAY NOT BE BUILT ASSETS, THEY MAY BE PIECES OF LAND, THEY MAY BE BODIES OF WATER, THEY MAY BE THINGS THAT HAVE AN INTEGRAL.

INHERENT VALUE THAT'S NOT NECESSARILY LINKED TO THE IMPROVEMENTS ON THOSE, BUT ARE PART OF THE FABRIC OF THE COMMUNITY THAT THEY INFORM SOME VERY IMPORTANT VALUES THAT WE HOLD.

WELL, I GUESS A LITTLE BIT FURTHER INTO THE WEEDS.

BUT WHEN YOU GO OUT AND YOU LOOK AT ASSET MANAGEMENT POLICIES ACROSS DIFFERENT COMMUNITIES, THEY TAKE DIFFERENT APPROACHES TO SCOPE.

A LOT OF THE SMALLER COMMUNITIES THAT ARE JUST GETTING STARTED WILL SET THEIR SCOPE IS TO BE VERY EXPLICITLY ASSETS THAT HAVE A CAPITAL VALUE OVER $50,000.

THE REASON THEY'RE DOING THAT IS BECAUSE THEY HAVE ABSOLUTELY NO DETAIL AS TO WHAT THEY OWE.

THE CITY OF YELLOWKNIFE IS NOT IN THAT POSITION, WE ACTUALLY HAVE QUITE A BIT OF DETAIL AS TO WHAT WE OWN.

WE HAVE A ROBUST JIS SYSTEM THAT TRACKS QUITE A FEW DIFFERENT CLASSES OF ASSETS SO WE'RE ABLE TO HAVE A MUCH BROADER SCOPE THAN THAT.

WHEN YOU LOOK AT OTHER MUNICIPALITIES THAT ARE FURTHER ALONG IN THEIR ASSET MANAGEMENT JOURNEY, THEY ARE STARTING TO LOOK AT BEYOND THE BUILT, THE ENGINEERED ASSETS.

SO THEY'RE LOOKING AT THINGS LIKE PUBLIC ART, WHICH IS MORE OF A SOCIAL CULTURAL ASSET, OR THEY'RE STARTING TO LOOK AT WHAT ARE CALLED NATURAL ASSETS, SO LAKES, TREES, THE VALUE OF WETLANDS AND THE NATURE AROUND US IN TERMS OF WHAT THEY CAN PROVIDE FOR THE SERVICES THAT THE CITY ENJOYS.

WE BUILT THE SCOPE TO EXPAND OVER TIME TO BE ABLE TO INCLUDE THESE THINGS.

WHEN IT CAME TO THE PHRASING ABOUT JUSTIFYING THE COST OF FORMAL MANAGEMENT, IT'S JUST TO REALLY TRY AND PUT SOME RAINS ON IT, WHICH IS WE'RE NOT GOING TO TRY AND TRACK EVERYTHING, WE'RE NOT GOING TO TRACK EVERY WRENCH, EVERY NUTS, EVERY BOLTS.
